3. ACCOUNT REGISTRATION
Accounts require accurate personal and business details. User must keep login credentials confidential and notify [email protected] immediately of unauthorized access.
4. FEES AND BILLING
Paid tiers include monthly or annual subscription fees. Automatic renewals occur unless canceled in the user dashboard at least five days before the billing cycle ends. Refund requests must be sent to [email protected]. Refund approvals depend on detailed review of usage logs, contract term duration, and promotional terms.
5. USER OBLIGATIONS
Users must comply with local, state, and federal laws related to digital marketing and data protection. Users cannot post infringing content, attempt unauthorized server access, or use scraping tools beyond the functionality explicitly provided by Rank Hogs. Violations result in immediate suspension and potential legal recourse.
6. INTELLECTUAL PROPERTY
ShakeUp LLC retains all IP rights in branding, proprietary algorithms, custom reporting interfaces, and workflow designs. Users receive a non-transferable, revocable license to access platform features solely for internal business purposes. Unauthorized copying or reverse-engineering of source code is prohibited.
7. THIRD-PARTY INTEGRATIONS
Rank Hogs may integrate with Google Search Console, Google Analytics, or other third-party APIs. Connection failures or data inaccuracies arising from third-party downtime, API changes, or discontinued partnerships do not entitle users to damages.
8. CONFIDENTIAL INFORMATION
User data is stored on secure servers hosted by vetted providers. Authorized personnel at ShakeUp LLC access user data for troubleshooting or account support only. Users must protect API keys, custom tokens, and private ranking data from unauthorized disclosure.
9. WARRANTIES
Rank Hogs disclaims any implied warranties of merchantability or fitness for a particular purpose for all automated SEO or analytics outputs. Forecasts and performance insights rely on changing search engine algorithms and do not guarantee future ranking positions or traffic results.
10. LIMITATION OF LIABILITY
ShakeUp LLC’s liability for direct damages relating to software malfunctions, data loss, or inaccurate reporting is capped at the total subscription fees paid in the preceding three months. ShakeUp LLC is not liable for indirect, incidental, or consequential damages including lost profits or third-party claims.
11. INDEMNIFICATION
Users shall indemnify ShakeUp LLC for claims or damages arising from wrongful use of the platform, unauthorized sharing of login details, violation of intellectual property rights, or breach of these Terms.
12. TERMINATION
ShakeUp LLC reserves the right to terminate or suspend access for breach of these Terms or suspected unlawful behavior. Users can cancel subscriptions anytime via the user dashboard. Post-termination, user data may be kept up to 90 days for billing record retention.
13. GOVERNING LAW
These Terms are governed by the laws of the State of Kansas. All disputes or claims must be filed in state or federal courts located in Kansas.
14. CHANGES TO TERMS
Material modifications require notice emailed to the address on file. Continued use after effective date of updated Terms indicates acceptance.
